having an address of and
Cpanel WHM Panel will incur an extra
$25.00/mth fee.
The
rendering of an invoice(s) by Canaca shall be
construed as an offer to extend this agreement and the payment of such
invoice(s) by customer shall be construed as an acceptance. If such
invoice(s) are not paid within fifteen (15) days of presentment, in the legal
money of the
Dedicated Servers Past Due Policy 1) 7 days past due- access disabled 2) 14 days past due-Remote telnet/ftp access disabled 3) 21 days past due- Machine disconnected from network 4) 28 days past due-Disk rebuilt for other customer
For the initial term of 1 month Customer agrees to pay Canaca the sum of $149.90 or $174.90 if Cpanel is chosen U.S / This includes a one-time setup fee $99.95 . A rate of $49.95 or $74.95 a month if Cpanel is chosen shall be available at the time of contract renewal for the first 3 months of your service. Beyond the 3 month special peroid you will be charged $149.95/mth ------------------- The Dedicated Server shall be connected through one or more links and nodes into the internet backbone. Canaca shall have total discretion as to the physical location of the server.
Canaca shall provide a working copy of the Linux operating system and Apache Web Server software along with domain maintenance software for use by Customer on the server. The provision of such software does not constitute any transfer of ownership of the software to Customer, and Customer may not remove or copy the software.
The terms and condition of service, and the standards of service specified in the Canaca.com Web pages located at URL http://www.canaca.com/contract.html are hereby incorporated by references and are part of this agreement. The terms and conditions may be changed by Canaca.com from time to time.
Changes notwithstanding, the terms and conditions as published upon the date of signing of this agreement shall apply through the initial term. The terms and conditions as published upon each extension of this agreement shall be applied through the term of the extension.
Canaca shall not be responsible or liable for direct of consequential damages caused by acts of government, insurrection, riot, civil disturbance, outages suffered by electric utilities, or outages suffered by RPOAs or intermediary private networks over whose facilities Customer Web traffic is carried to and from the Web Server provided by Canaca
Even if Canaca were to be found to be negligent or at fault, Canaca shall not be liable for more than a refund of the monies paid by Customer to Canaca. Canaca makes no representation as to the merchantability or fitness for any purpose of the Web server and ancillary derive to be provided to customer.
Customer agrees to comply with all applicable governmental laws in there use of the Web Server and ancillary services provided by Canaca, and, in the event of any non-compliance, agrees to hold harmless Canaca and its personnel and contractors from the consequence of such non-compliance.
Customer
may resell Web space on the server provided by Canaca
under this agreement, so long as the use of such resold space does not
violate the terms and conditions of service incorporated in this agreement.
Customers shall be responsible for any domain registration fees that may be applicable to domains hosted on the server.
If any action in law or equity is instituted by either party hereto with respect to the subject matter of this agreement, the prevailing party shall be entitled to recover, in addition to any other relief granted, reasonable attorney’s fees, legal costs, and expenses reasonably incurred.
This is the entire agreement. It may not be changed orally. Any waiver, alteration, or modification of any of the provisions of this agreement will not be valid unless in writing signed by both parties.
